Welcome to Mosafy! These Terms and Conditions apply to your use of our website and your purchases from our United States storefront. Please read them carefully before placing an order.

1. Applicability

These Terms and Conditions apply to all offers, orders, and agreements made through www.mosafy.com for customers in the United States.

By placing an order, you agree to these Terms and Conditions.

2. Products and Orders

• All our photo mosaics are custom-made using the photos you provide.

• After placing an order, you will receive an order confirmation by email.

• Because our products are personalized, cancellation is only possible before production has started, except where applicable law provides otherwise.

3. Prices and Payments

• Prices displayed on our United States storefront are in US dollars (USD), unless otherwise stated.

• Any applicable sales tax will be displayed at checkout before you complete your purchase.

• Payments are processed through the secure payment methods available at checkout.

• Mosafy reserves the right to change prices and offers. Such changes will not affect orders that have already been accepted.

4. Delivery and Shipping

• Shipping within the United States is free.

• Orders are shipped from Texas.

• Physical mosaics typically require 1–2 business days for production.

• Delivery takes up to 5 business days after shipping, depending on your location. Business days exclude weekends and public holidays.

• If we cannot ship your order within the promised timeframe, we will notify you and provide any options required by applicable law, including the option to accept a revised shipping date or cancel for a full refund.

• Please check your delivery address carefully before placing your order. An incorrect or incomplete address may cause delivery delays or additional costs. If you notice an error, contact us as soon as possible.

5. Returns and Cancellations

• Because our products are personalized and made to order, we do not accept returns for a change of mind.

• If your product arrives damaged, has a manufacturing defect, or does not match your order, please contact us at support@mosafy.com within 14 days of delivery so we can resolve the issue promptly.

• Once the issue has been reviewed and approved, we will provide a replacement or refund, as appropriate.

• Please contact us before returning any product so we can provide instructions.

• Nothing in this policy limits any rights or remedies you may have under applicable law.

6. Liability

• Mosafy is not responsible for damage caused by improper use or handling of the product.

• Minor color differences between the digital preview and the printed product may occur because of screen settings and the printing process. These differences alone do not constitute a manufacturing defect.

• To the extent permitted by applicable law, Mosafy’s liability in connection with a product is limited to the amount paid for that product.

• These limitations do not exclude or restrict liability or consumer rights that cannot legally be excluded or restricted.

7. Intellectual Property and Uploaded Photos

• All designs, images, and website content owned by Mosafy may not be copied or used without our permission.

• By uploading photos, you confirm that you own them or have the necessary rights and permissions to use them for your order.

• You retain ownership of your uploaded photos. You grant Mosafy a limited license to use, reproduce, and process those photos solely to create and fulfill your personalized order.

8. Privacy

We respect your privacy and process personal information in accordance with our Privacy Policy.

9. Governing Law and Disputes

• These Terms and Conditions are governed by the laws of the Netherlands, subject to any mandatory consumer protections that apply to you.

• Disputes will be submitted to the competent court in Amsterdam, the Netherlands, unless applicable law gives you the right to bring a claim in another jurisdiction.

• Nothing in these Terms and Conditions limits any mandatory rights you have under applicable United States federal or state law.
